Eligibility for the daily living component of ADP

Standard rate

An individual is entitled to the daily living component at the standard rate if both of the following apply:

• the individual’s ability to carry out daily living activities is limited by the individual’s physical or mental health condition or conditions (ADP regs, Reg 5(1)(a)), and
• the individual meets the required period condition (ADP regs, Reg 5(1)(b) taken with reg 11)

Enhanced rate

An individual is entitled to the daily living component at the enhanced rate if both of the following points apply:

• the individual’s ability to carry out daily living activities is severely limited by the individual’s physical or mental health condition or conditions (ADP regs, Reg 5(2)(a)), and
• the individual meets the required period condition (ADP regs, Reg 5(2)(b) taken with reg 11)
