Residence and presence

This chapter is relevant to Carer Support (The Carer’s Assistance (Miscellaneous and Consequential Amendments, Revocation, Transitional and Saving Provisions) (Scotland) Regulations 2025) applicants, both:

  • new applicants, and
  • those already in receipt of assistance.

It outlines how the rules for Carer Support should be applied to decide if the applicant meets the residence and presence criteria (Regulation 9 of the Carer Support Regulations 2025 amends Regulation 7 of The Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023).

The residence and presence criteria must be met by the carer who is applying for Carer Support, rather than the person they care for.

The applicant must satisfy a number of residence and presence criteria to be eligible for an award. Those criteria differ depending on the applicant’s personal circumstances.
