Appealing against a decision of the First-tier Tribunal
A decision of the First-tier Tribunal can be appealed to the Upper Tribunal. The Upper Tribunal hears appeals on decisions of the chambers of the First-tier Tribunal.
A decision can be appealed by any party in the case but only on a point of law (Tribunals (Scotland) Act 2014, s.46(1) and s.46(2)) .
An appeal of a First-tier Tribunal decision requires the permission of the First tier Tribunal. If the First-tier Tribunal refuses its permission, the Upper Tribunal can give permission for the appeal (Tribunals (Scotland) Act 2014, s.46(3)).
