Ending the client’s Disability Living Allowance award

When a case completes the transfer process, the client’s entitlement to Disability Living Allowance will usually cease on the date their entitlement to Adult Disability Payment begins (ADP Transitional and Miscellaneous Amendment Regs, reg 7(1)(a)).

Example: Disability Living Allowance ends on completion of case transfer

Mike’s Adult Disability Payment started on 30 June when the transfer determination was made. This transfer determination ended his Disability Living Allowance award on the same date, meaning his last day of entitlement to Disability Living Allowance was on 29 June.

There are two exceptions to this:

  • when a client has received their payment on a “3+1” payment cycle (i.e. 3 weeks in arrears, 1 week in advance) the Disability Living Allowance entitlement will end a week after the date the Adult Disability Payment begins (ADP Transitional and Miscellaneous Amendment Regs reg 7(1)(b))
  • where the client’s Adult Disability Payment award is backdated because they meet the special rules for terminal illness (see para 24), the client’s entitlement to Disability Living Allowance ceases on the day the client’s Adult Disability Payment would have begun, had the award not been backdated (ADP Transitional and Miscellaneous Amendment Regs, reg 7(1)(c)).
