Clients over 16 who are in receipt of child DLA when they move

A small number of young people may still be receiving child DLA when they move to Scotland, despite being over 16. This could be if they have just turned 16, if they are terminally ill, or if they have been in hospital for a prolonged period. 

For this reason, the cross border regulations allow young people to apply for CDP  up until the age of 18 if they were in receipt of child DLA when they moved.

(CDP Regs 35(1)(a)).

In order to have their entitlement backdated to the day after their DWP entitlement ends and avoid a possible gap in entitlement, young people in receipt of DLA-c who move to Scotland must apply for CDP.

It is possible for cross border clients to apply for the equivalent Social Security Scotland benefit while still in receipt of their DWP benefit. This is designed to reduce the possibility of gaps in payment while their application to Social Security Scotland is being considered. This rule does not extend to other benefits. Young people cannot apply for ADP while still in receipt of child DLA. 

There is nothing stopping these applicants from applying for ADP once the DWP 13 week run on has ended, but they could only paid  from the date of their ADP application.  

Once the client has been awarded CDP, they can apply for ADP and specific rules apply to them, such as being able to apply for ADP while still in receipt of CDP.
