Who is in the First-tier Tribunal
The Social Security Chamber of the First-tier Tribunal has between one and three members, depending on the type of appeal.
For Carer Support Payment, the First-tier Tribunal must consist of one legal member (The First-tier Tribunal for Scotland Social Security Chamber and Upper Tribunal for Scotland (Composition) Regulations 2018, regulation 2(2)).
This differs from Adult and Child Disability Payment appeals, where one ordinary member with medical experience and another with disability experience would also sit on the panel.
Cases to decide an appeal against a process decision must consist of only one legal member (The First-tier Tribunal for Scotland Social Security Chamber and Upper Tribunal for Scotland (Composition) Regulations 2018, regulation 3).
