Residence criteria for the protected cohort

The criteria which apply to individuals in the protected cohort are that the applicant:

• is habitually resident in the UK, or habitually resident in an EEA member state other than the UK, or habitually resident in Switzerland. See Habitual Residence in the Common Travel Area; and
• is subject to Title III of Part 2 the Withdrawal Agreement, Part 3 or Article 23(4) of the Swiss Citizens’ Rights Agreement, or Title III of the EEA EFTA Separation Agreement. See Personal Scope of the EU Coordination Rules; and
• has a ‘genuine and sufficient link’ to Scotland.
