Case Transfer Scheduled Review

Where a Scottish resident, in receipt of Personal Independence Payment is coming to the end of their fixed term Personal Independence Payment award or where their Personal Independence Payment award is scheduled to be reviewed, their case will be selected for transfer. Their Adult Disability Payment award will begin on a like-for-like basis with their Personal Independence Payment award and a scheduled review date set. Their scheduled review begins on this date.

Case transfer scheduled review backdating

As part of a scheduled review, clients may report a change in their condition. A change of condition reported in a scheduled review could lead to an increase or decrease in their Adult Disability Payment award. An increase and decrease have different backdating effective dates.

Increased entitlement

Where:

  • the client’s Personal Independence Payment award was selected for transfer because it was scheduled to be reviewed; and
  • the first scheduled review of the Adult Disability Payment award leads to an increase in that award

that increased Adult Disability Payment award should be backdated to:

  • the day the client’s award was selected for transfer; or
  • the date the client first satisfies the requirements for an increased rate of the daily living or mobility component whichever is later.

It would be unjust to begin entitlement any later than this as these dates are consistent with when the client’s Personal Independence Payment award could be increased if their award wasn’t selected for transfer. The rule to set an earlier date for entitlement should be used as otherwise the client may have been better off had they remained on Personal Independence Payment (Adult Disability Payment regs, Reg 45(2)).

Example

David lives in Scotland and had his Personal Independence Payment award selected for transfer to Adult Disability Payment because he had an upcoming review date. The case transfer process began on 1 March 2024. The process completed on 31 May 2024 which means David’s Adult Disability Payment award begins on this date. David’s ADP review date is set for 26 July 2024. On this date, David has a review form sent to him by Social Security Scotland as part of the scheduled review process. In the review form, David reported a change of his condition that began in 5 November 2023. This leads to an increase in the mobility component of his Adult Disability Payment award, with David first satisfying the conditions 13 weeks from the date of change which would be 4 February 2024. The effective date of this increased entitlement is 1 March 2024, the date his case was selected for transfer, as this is the latest of the two dates. This is selected to ensure that David has not missed out financially because of the case transfer process compared to if he remained on Personal Independence Payment.

Where:

  • the client’s Personal Independence Payment award was selected for transfer because it had a fixed term end date; and
  • the first scheduled review of the Adult Disability Payment award leads to an increase in that award

the increased Adult Disability Payment award should not be backdated. The usual Adult Disability Payment scheduled reviews rules should be followed.

The award should increase from:

  • the date the case manager makes the determination; or
  • the date the client first satisfies the requirements for an increased rate of the daily living or mobility component

whichever is later.

Decreased entitlement

The Adult Disability Payment award should not be backdated where:

  • The client’s Personal Independence Payment award was selected for transfer because it was scheduled for review; or
  • The client’s Personal Independence Payment award was nearing its fixed term end date; and
  • The initial review of the Adult Disability Payment award leads to a decrease in that Adult Disability Payment award

In this scenario any decrease should take effect from the date of the determination without application resulting from the scheduled review (the date the decision is made). This is because the transfer process may have contributed to delaying the subsequent review and it would be therefore unjust to reduce the award before this date (Adult Disability Payment regs, Para 46(2)).

Example

Laura has a Personal Independence Payment award that is due a review. The review is due to begin on 15 November 2023 (this is when she would be sent the AR1 form). Her award is instead selected for transfer to Adult Disability Payment on the same date. The transfer process completes and Laura’s Adult Disability Payment award begins on 14 February 2024. Her ADP review date is 10 April 2024. As part of the review, Laura reports that her condition has improved. The case manager carrying out this scheduled review makes the determination to reduce her award on 19 June 2024. Laura’s new level of entitlement begins from this date. The case manager does not need to backdate to the date the case was selected for transfer.

Note that these scheduled review rules only apply to the first determination made after someone’s award was transferred from PIP to Adult Disability Payment because their PIP award was due to be reviewed or end. Any subsequent scheduled reviews will be subject to the usual effective date rules (Adult Disability Payment regs, Regs 45 and 46).

Changes reported to DWP after a case is selected for transfer but before transfer completes

Where someone reports a change to DWP after their case has been selected for transfer because it was scheduled to be reviewed, but before the transfer completes (i.e. they report a change of circumstances during the transfer window), the award is subject to the case transfer unscheduled review rules (Adult Disability Payment regs Sch 2, Part 3, Para 9(4)(a)(i)).

Example

Ashni had her Personal Independence Payment Award selected for transfer on 1 May 2024 because it was due to be reviewed. The transfer is due to complete on 7 August 2024. On 20 July 2024, Ashni reports to the DWP that her needs have increased from 1 July 2024. As her award has already started the transfer process, Social Security Scotland send her a review form. On 7 August 2024, the transfer determination of Adult Disability Payment is made which is like-for-like with the PIP award. It doesn’t include any of the changes Ashni reported. As soon as practicable after the transfer determination is made, a case manager considers the change and decides her award should be increased. The case manager applies the case transfer specific unscheduled review rules to the Adult Disability Payment award. As the change occurred on 1 July 2024 and was reported within one month, her award is increased from 30 September 2024 – 13 weeks after the change occurred.

Changes reported to Social Security Scotland after a case is selected for transfer but before their scheduled review date

Where someone reports a change to Social Security Scotland after their case has been selected for transfer because it was scheduled to be reviewed, but before their Adult Disability Payment scheduled review date, the award is subject to the normal Adult Disability Payment unscheduled review rules.

Note that this can result in an effective date that pre-dates the start of the Adult Disability Payment award. In these cases, the Adult Disability Payment award should be backdated. Any payment of Adult Disability Payment made for this past period should be reduced by the amount of Adult Disability Payment or Personal Independence Payment already received (Adult Disability Payment regs, Sch 2, Part 3, Para 14(c)).

Example

Susan had her Personal Independence Payment award selected for transfer on 9 July 2024 because she was due a PIP review. Her transfer completed and her Adult Disability Payment award began 8 October 2024. Her Adult Disability Payment award is scheduled to be reviewed on 3 December 2024. On 1 November 2024, before Susan’s review date, she completes a change of circumstances form and submits this to Social Security Scotland. Now that Susan has reported a change of circumstances, the case manager should follow the usual Adult Disability Payment unscheduled review process as this reported change of circumstance supersedes the scheduled review. Upon considering the change, the case manager decides Susan’s ADP award should be increased. Susan has told us that the change occurred on 2 September 2024, therefore she has reported this to Social Security Scotland later than a month after the change occurred but before 13 months. The case manager decides that Susan had good cause not to notify within one month as it is reasonable that Susan was waiting on her case transfer being completed before contacting Social Security Scotland. Susan’s award is increased from 4 December 2024 – 13 weeks after the change occurred as this is when Susan satisfies the backwards test. The case manager also sets a new review date of 5 May 2030 which replaces her initial review date of 3 December 2024. When her award is next reviewed, the normal scheduled review rules apply.
