When a previous determination is based on an error or made in ignorance of a material fact

This chapter is about Carer Support Payment. It focuses on when Social Security Scotland identifies that a determination has been:

  • based on an error (including an official error)
  • made in ignorance of a material fact

Determinations based on an error can cause an individual to:

  • receive less or more assistance than they are entitled to
  • receive an award to which they are not entitled
  • not receive an award to which they are entitled

Establishing when an increase or decrease in entitlement begins will be based on whether the original determination was made in:

  • error (including official error) leading to an overpayment
  • official error leading to an underpayment; or
  • ignorance of a material fact
