When a previous determination is based on an error or made in ignorance of a material fact
This chapter is about Carer Support Payment. It focuses on when Social Security Scotland identifies that a determination has been:
- based on an error (including an official error)
- made in ignorance of a material fact
Determinations based on an error can cause an individual to:
- receive less or more assistance than they are entitled to
- receive an award to which they are not entitled
- not receive an award to which they are entitled
Establishing when an increase or decrease in entitlement begins will be based on whether the original determination was made in:
- error (including official error) leading to an overpayment
- official error leading to an underpayment; or
- ignorance of a material fact
