Deadlines for cross border applications
For disability benefits, the full name and date of birth of the person moving from elsewhere in the UK to Scotland must be provided to Scottish Ministers within 26 weeks of the date of move. This means the individual must submit the ‘part 1’ of their application or request for disability benefits to Social Security Scotland within 26 weeks of moving to Scotland.
(CDP Regs 35(3)(a), ADP Regs 52(3)(a), PADP Regs 44(3)(a), SADLA Regs 47(1)(e)(i)).
The client must then submit their full application or request, or ‘part 2’ within:
- 32 weeks of the date of move for CDP
- 34 weeks of the date of move for ADP, PADP and Scottish Adult DLA
The 6 week period for CDP and 8 weeks for ADP, PADP and Scottish Adult DLA to complete part 2 after part 1 has been submitted is the same amount of time allowed for new applications.

For Carer Support Payment the client must submit their full application within 26 weeks of the date of move as there is no ‘part 1’ or ‘part 2’.
