Cared for person withdraws a dispute
A cared for person may contact Social Security Scotland to withdraw a dispute they had raised on someone’s Carer Support Payment or Carer Additional Person Payment.
If an award has not yet been made on a new application, we can send the cared for person a letter to inform them that the dispute is closed. The application would then be processed in the normal way.
If the carer was already receiving Carer Support and the dispute is withdrawn before any changes were made to the award, the cared for person will receive a letter to inform them that the dispute is closed. The carer would not receive any new notification because there would be no need for any new determination without application to be carried out as the award has not changed.
If the dispute is withdrawn after action has been taken to stop entitlement for Carer Support Payment or Carer Additional Person Payment, the carer will have already received a letter informing them that they have been denied Carer Additional Person Payment component of Carer Support or where they are no longer entitled to Carer Support Payment, that their whole award of Carer Support has ended.
In these circumstances, a new determination would need to be made and the carer would receive a change of award letter, setting out their entitlement to Carer Support and the individual components which they had been awarded. They would also be advised of any backdated entitlements that they are due, as long as they met all of the eligibility criteria throughout the period in question.
