If a re-determination of Carer Support Payment is ongoing at 15 March 2026
Regulations establishing Carer Support come into force on 15 March 2026 and existing awards of Carer Support Payment will be transferred to an award of Carer Support effective from that date (Schedule 2, The Carer’s Assistance (Miscellaneous and Consequential Amendments, Revocation, Transitional and Saving Provisions) (Scotland) Regulations 2025). The previous version of the regulations still applies to any re-determination of Carer Support Payment which relates to the period before 15 March 2026 (The Carer’s Assistance (Miscellaneous and Consequential Amendments, Revocation, Transitional and Saving Provisions) (Scotland) Regulations 2025, regulation 5).
If there is no current award of Carer Support Payment, but a re-determination in relation to an award of Carer Support Payment is ongoing on 15 March 2026, the case will not transfer to Carer Support on that date, and the re-determination will be completed under the Carer Support Payment Regulations as they applied before 15 March 2026, as noted above. If the re-determination is made that the person is entitled to Carer Support Payment in respect of 14 March 2026, we can then make a transfer determination without application.
