Part of Carer Support Payment decision making guide

Over-payments and under-payments

There may be occasions where individuals receive payments of Carer Support that they are not entitled to.(Carer Support Payment Regulations, Regulation 38)

This may mean the individual may be required to repay some or all of what they received in error.(Social Security (Scotland Act) 2018 , s 63 and Social Security (Scotland Act) 2018 , s 64)

Individuals may be due more money than they have received if:

  • they have not received all of the Carer Support to which they are entitled
  • Carer Support has been reduced due to overlapping benefits in error (Carer Support Payment Regulations, Regulation 37)
