Re-determinations and appeals
The Carer Support Payment transfer determination made at the point of case transfer is subject to the same rights to re-determination and appeal as any other Carer Support Payment determination (Section 41 of the Social Security (Scotland) Act 2018).
Example: Re-determination for case transfer Carer Support Payment determinations
Miranda’s Carer’s Allowance award transferred last week and her initial Carer Support Payment determination was made.
Her Carer Support Payment award is exactly the same as it was for Carer’s Allowance – she is entitled to Carer Support Payment but her payments are reduced to zero due to overlapping benefits she receives.
This is known as underlying entitlement. However, Miranda does not feel her Carer Support Payment award accurately reflects her circumstances. She can request a re-determination of her Carer Support Payment determination within the time limit.
