Applying for a written statement of reasons

Any party to the appeal can make a written application to the First-tier Tribunal for a written statement of reasons. They have to apply within 31 days of the decision notice being presumed to have been received by the individual. An application for a written statement of reasons can be made (The First-tier Tribunal for Scotland Social Security Chamber (Procedure) Regulations 2018, Schedule, para 29(2)):

  • if the First-tier Tribunal has not already sent them a written statement of reasons
  • even if the reasons were given verbally at the hearing

The First-tier Tribunal must then issue the written statement of reasons to both parties either:

  • within 31 days of receiving the application from a party
  • as soon as it is reasonably practicable after 31 days have passed
