Who is in the First-tier Tribunal

The Social Security Chamber of the First-tier Tribunal has between one and three members, depending on the type of appeal.

For CDP, where the appeal involves consideration of the impact of the individual’s physical condition or mental health in relation to an award of disability assistance, the First-tier Tribunal must consist of (FtT for Scotland SSC and UT for Scotland (Composition) Regs 2018, reg 2(2) 53):

  • one legal member
  • one ordinary member with medical experience
  • one ordinary member with disability experience

Cases to decide an appeal against a process decision must consist of only one legal member (FtT for Scotland SSC and UT for Scotland (Composition) Regs 2018, reg 3).
