Making an application before residence and presence requirements met

An application can be submitted for an individual who does not meet the residence and presence conditions on the date that the application is submitted.

An individual may be taken to have met these conditions if they meet them within 13 weeks of the application being received (CDP regs, reg. 24(2)(a)(ii) and (b)).

In this circumstance, a case manager may determine that the individual is entitled to Child Disability Payment (CDP) from the date when they meet the residence and presence conditions. This is provided that the individual meets the other eligibility criteria.
