Significant portion

The term “significant portion” means neither trivial nor negligible and is a question of fact.

What may amount to a “significant portion of the day” depends largely on an individual’s own circumstances. An hour may be considered reasonable in many cases. Attention required for a period of less than an hour may be sufficient if the attention:

  • is provided on a considerable number of short occasions and produces other disruptions to the carers day
  • required is very intense. This means things like such as cleaning up after faecal incontinence or administering complex therapies.
