Payment of CDP ending due to determination of ADP
An individual’s entitlement to CDP will end when they reach 18 unless they have submitted a full application for Adult Disability Payment (ADP) before turning 18. There are some exceptions where entitlement can continue beyond 18 (CDP regs, reg. 4(1)).
If an individual submits a full application for ADP before they turn 18 or an individual is found to be entitled to ADP but payment has not begun, their entitlement to CDP can continue until the age of 19, or the day the individual becomes entitled to Adult Disability Payment, whichever is earlier.
If the individual is found to be entitled to ADP, a determination without application is automatically completed to end (CDP regs, reg. 29(b(ia))) their entitlement to CDP on their next payment date after the date the determination of entitlement for ADP has been made (CDP regs, reg. 4(1B(d))).
Peter is 17 and is entitled to CDP. He has been invited to apply for ADP as he will turn 18 on 15th February. Peter completes part 1 and 2 of his ADP application and submits them on 1st February. A case manager makes a determination on 12th February that Peter is entitled to ADP. Peter’s next payment of CDP is due to be paid on 20th February. Therefore Peter’s entitlement to CDP will end on 20th February and entitlement to ADP will begin the next day, on 21st February.
If the individual is found not to be entitled to ADP, and they are over the age of 18, their entitlement to CDP will end on the day a determination is made on their ADP application.
Jean will turn 18 on 20th April. They submit a full application for ADP on 20th April. A case manager makes a determination on 1st June that Jean does not meet the criteria for an award and is therefore not entitled to ADP. Therefore Jean’s entitlement to CDP beyond 18 will end on 1st June, the day the case manager makes the determination.
