Considering whether to make an appointment to act on child's behalf

Social Security Scotland may consider making an appointment to act on the child's behalf if there is no one who meets all of the following (1 SS(S)A 2018, s. 85A(3)):

  • has authority to act on behalf of the child lives with, and has care of, the child
  • is willing and practicably able to act on the child's behalf.

All of the above conditions must be met before Social Security Scotland can consider making an appointment.
